1. Agreement to these Terms
These Terms of Service (the "Terms") form a binding agreement between you ("you", "user") and Wesley B. Calloway, sole trader established in Slovakia, trading as Just Talk English (the "Provider", "we", "us", "our"), and govern your access to and use of Word Rizzler and any related websites, apps, APIs, content, audio, and features (collectively, the "Service"). By creating an account, clicking "I agree", or otherwise accessing or using the Service, you confirm that you have read, understood, and accepted these Terms, the Privacy Policy, the Refund Policy, and any in-product notices we present at checkout or sign-up. If you do not agree, you must not use the Service.
We may update these Terms from time to time. The current version and date are shown above. Continued use of the Service after an update constitutes acceptance of the revised Terms. If a change materially reduces a paid feature, we will notify active subscribers by email or in-product banner before the change takes effect.
2. Definitions
- "Account" – the personal profile you create to access the Service.
- "Credits" – the in-app units consumed when you use paid actions (lookups, generations, exports, etc.).
- "Content" – any text, audio, images, definitions, examples, stories, audiobooks, glossaries, prompts, or other material produced by, displayed on, or submitted to the Service.
- "AI Output" – Content generated automatically by language or speech models in response to your inputs.
- "User Content" – Content you submit, upload, save, or generate inputs for, including saved words, custom story prompts, and personal-story details.
- "Subscription" – any recurring or fixed-term paid plan, including "Unlimited" plans.
- "Merchant of Record" – the party legally responsible for the sale, invoicing, tax, refund, and chargeback handling of a transaction (see Section 7).
3. Eligibility
The Service is intended for users aged 16 or older. If you are between 13 and 16, you may only use the Service with the verifiable consent of a parent or legal guardian, who accepts these Terms on your behalf. We do not knowingly collect data from children under 13 and will close any account we believe belongs to a child under 13.
You confirm that you have legal capacity to enter this contract, that the information you provide on signup is accurate, and that you are not located in, under the control of, or a national of any country subject to a comprehensive embargo by the European Union or the United States, and not on any restricted-party list.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity that occurs under your Account. You agree to use a strong, unique password, to enable any additional security features we offer, and to notify us promptly at justtalkenglish@gmail.com if you suspect unauthorised access. We may, at our discretion, suspend or terminate Accounts that show signs of compromise, fraud, abuse, or repeated chargebacks.
You may not create more than one Account for yourself, use another person's Account without permission, transfer or sell your Account, or use the Service in a way that misrepresents your identity. Free-tier credit grants are tied to a verified email and may be reduced or revoked if we detect attempts to multi-account or to abuse referral or daily-free allowances.
5. Description of the Service
Word Rizzler is an English-learning and reference tool. It offers AI-generated word, idiom, and slang definitions, example sentences, pronunciation guides, etymologies, a personal saved glossary, AI-generated short stories and audiobooks with synthetic narration, quizzes, progress tracking, and related learning tools. Features, models, voices, genres, credit costs, and limits are described in the in-product UI and may be changed, added, removed, or replaced at our discretion (see Section 13).
The Service is provided primarily as an educational and entertainment aid. It is not a certified dictionary, translation service, language test, accessibility aid, or substitute for professional instruction.
6. Acceptable use
You agree not to, and not to attempt to:
- use the Service for any unlawful, fraudulent, harassing, defamatory, hateful, sexually exploitative, or harmful purpose;
- submit prompts, words, or story details that target real, identifiable individuals in a defamatory or sexually explicit way, or that solicit content involving minors in any sexual or violent context;
- upload or generate content that infringes any copyright, trademark, trade secret, publicity, privacy, or other right of any third party;
- use the Service to create disinformation, impersonate any person or organisation, or generate material designed to deceive consumers about an authoritative source;
- extract, scrape, mirror, frame, crawl, or systematically download Content, definitions, audio, or any other output from the Service, whether manually or with bots, except via interfaces we explicitly publish;
- reverse-engineer, decompile, or attempt to discover the source code, prompts, model weights, or training data behind the Service, except to the limited extent permitted by mandatory law;
- resell, sublicense, rent, lease, or otherwise commercially redistribute the Service, AI Output, or audio narration, except as expressly allowed in writing;
- use the Service to train, fine-tune, evaluate, or benchmark any competing AI model or dataset;
- interfere with, overload, or disrupt the Service or its underlying infrastructure, or probe, scan, or test its vulnerabilities;
- circumvent or attempt to circumvent credit limits, daily-free allowances, paywalls, geo-restrictions, admin controls, or any other technical limitation.
We may investigate suspected violations, remove or restrict offending content or features without prior notice, and cooperate with law-enforcement authorities where required.
7. Merchant of Record (Paddle)
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all of our orders. Paddle handles payment processing, currency conversion, tax determination and collection, invoicing, subscription billing, dunning, chargebacks, and refunds in line with its Buyer Terms and Refund Policy. Billing and tax questions should be directed to Paddle through the receipt link or via paddle.net.
The price displayed at checkout is the price you pay. Applicable sales tax, VAT, or GST is added or included based on your declared billing country, as determined by Paddle.
8. Credits, plans, and renewals
- Credits are a prepaid licence to access paid actions. They have no cash value, are non-transferable, cannot be exchanged for fiat or cryptocurrency, and may expire as described in the in-product UI.
- Free credits granted on signup, as part of promotions, or as referral bonuses are discretionary and may be reduced, expired, or revoked at any time without notice if we suspect abuse.
- Subscriptions (including monthly and annual "Unlimited" plans) auto-renew at the then-current price unless cancelled before the renewal date. You can cancel any time from your Account or via the Paddle customer portal at paddle.net; access continues until the end of the paid period.
- Price changes to a renewing subscription will be notified by email at least 14 days in advance and only take effect at the next renewal.
- Payment cancellation. You are solely responsible for stopping your own recurring payments. We are not obliged to cancel subscriptions or stop payments on your behalf. To cancel a subscription or stop recurring charges, you must contact Paddle directly through the Paddle customer portal at paddle.net or by using the cancellation link in your Paddle receipt email. Because you control the start and continuation of your subscription through Paddle's systems, it is not possible to dispute recurring payments that you have not cancelled yourself.
- Refunds are governed by our Refund Policy and Paddle's policies. Credits already consumed are non-refundable.
9. Right of withdrawal (EU/EEA consumers)
If you are a consumer resident in the EU or EEA, you normally have 14 days from purchase to withdraw from a contract for digital services without giving any reason. By starting to use Credits, generating Content, or accessing subscription features immediately after purchase, you expressly request immediate performance of the contract and acknowledge that you lose your right of withdrawal once the service has been fully performed or, for partially used services, in respect of the part already supplied. Unused, untouched Credits remain refundable during the 14-day window in line with our Refund Policy.
10. Intellectual property
The Service, including its software, UI, copy, branding, curated dictionary content, voice models, prompt engineering, design system, and any aggregate or anonymised data derived from the Service, is owned by Wesley B. Calloway or its licensors and is protected by intellectual-property laws. Except for the limited rights granted in these Terms, no rights are transferred to you.
Subject to your compliance with these Terms, we grant you a personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service and the AI Output generated for your Account for your own private learning, study, and non-commercial enjoyment. Any other use — including republishing definitions on a website, redistributing audio narration, or feeding AI Output into another product — requires our prior written consent.
Third-party trademarks, names, and titles mentioned anywhere on the Service (including in AI-generated stories or examples) belong to their respective owners and are referenced for educational and illustrative purposes only. No endorsement is implied.
11. AI Output and reference content
- No guarantee of accuracy. Word, idiom, and slang entries, translations, pronunciations, etymologies, synonyms, antonyms, example sentences, story plots, and audiobook narration are produced algorithmically. We make no warranty that any output is correct, complete, current, or appropriate for any particular purpose.
- Regional & cultural variation. The same word can mean very different things in different regions, communities, registers, or time periods. Definitions reflect a best-effort general usage, not every dialect or sub-culture.
- Slang & sensitive language. The Service surfaces informal, regional, and adult slang for educational purposes. Some entries may be offensive, outdated, or inappropriate in certain contexts. We do not endorse any slur or pejorative; the inclusion of a term is purely descriptive.
- No professional advice. Nothing on the Service constitutes legal, medical, financial, psychological, safety, immigration, or translation advice. Do not rely on AI-generated stories, definitions, or examples for real-world decisions or for any high-stakes communication.
- Voice synthesis. Audio narration is machine-generated. Pronunciation, accent, intonation, and emotional delivery are approximate and may diverge from any specific human speaker, dialect, or recording.
- Reproducibility. AI Output is non-deterministic. The same input may produce different output on different runs, and we do not guarantee that any specific output can be reproduced.
- Hallucinations. Models may invent facts, citations, biographies, or quotations. Always verify anything you intend to rely on against an authoritative external source.
12. User Content and licence to us
You retain ownership of the words, prompts, sentences, custom-story details, narrator preferences, and other User Content you submit. By submitting User Content you grant Wesley B. Calloway a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, process, adapt, and display that User Content solely to operate, secure, maintain, and improve the Service for you (including generating audiobooks, quizzes, and AI definitions on your behalf, and enabling backups and abuse-prevention).
You represent and warrant that you have all rights necessary to submit your User Content and that it does not infringe any third-party right or breach any law. You are solely responsible for your User Content and for any consequences of submitting it.
We do not use your personal User Content to train third-party foundation models. Limited aggregate, de-identified usage statistics (e.g., "how many users looked up an idiom this week") may be used to improve the Service.
13. Service modifications & admin controls
The Service is provided as an evolving product. Wesley B. Calloway may, at any time and at its sole discretion:
- add, rename, reorder, deactivate, or delete audiobook genres, story themes, narrator voices, reading levels, daily-word categories, or any other catalogue content;
- adjust the starting credit balance granted to new accounts, the price of any feature, the credit cost of any action, or the daily-free allowance;
- add, remove, redesign, or change features, free-hours windows, referral rewards, and promotional offers;
- moderate, edit, hide, or remove any User Content (saved words, custom stories, profiles, referrals) that breaches these Terms or applicable law;
- impose rate limits, queue requests, or temporarily disable features to protect the stability or security of the Service.
We will give reasonable notice of material changes that adversely affect paying subscribers (typically 14 days). Changes to free-tier features, catalogue content, or non-material UI may take effect immediately. If a material change is unacceptable to you, your sole remedy is to cancel your subscription and request a prorated refund of any unused, prepaid period as described in the Refund Policy.
14. Third-party services
The Service relies on third-party providers for hosting, authentication, payments, AI model inference, speech synthesis, email delivery, analytics, and abuse prevention. A current list and their roles is described in the Privacy Policy. We are not responsible for the practices, outages, or content of third-party services beyond our reasonable control, but we will use commercially reasonable efforts to choose reputable providers and to handle outages gracefully.
15. Suspension & termination
You may stop using the Service at any time and may delete your Account from the Settings page. Deletion removes your profile, saved glossary, and personal data within 30 days, except where we are required by law to retain limited records (e.g., billing).
We may suspend or terminate your Account or restrict access to any feature, with or without notice, if you breach these Terms, if your use poses a security or legal risk, if your payment is reversed or fails, or if we are required to do so by law. On termination, any unused Credits are forfeited unless the termination was caused by our material breach, in which case Section 8 and the Refund Policy apply.
16. Disclaimers
To the maximum extent permitted by law, the Service and all AI Output are provided "as is" and "as available", without any warranty of any kind, whether express, implied, statutory, or otherwise — including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, currency, security, uninterrupted availability, or non-infringement. We do not warrant that definitions are correct, that audio narration is accurate, that the Service will meet your requirements, or that any errors will be corrected.
17. Limitation of liability
To the maximum extent permitted by law, Wesley B. Calloway and its affiliates, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profit, revenue, data, goodwill, business opportunity, or learning outcome, even if advised of the possibility. Our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) EUR 50.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under mandatory consumer-protection or product-liability law, including statutory rights of EU consumers.
18. Indemnity
To the extent permitted by law and excluding consumer claims arising from your personal, non-commercial use, you agree to defend, indemnify, and hold harmless Wesley B. Calloway from any third-party claim, demand, loss, or expense (including reasonable legal fees) arising out of (a) your User Content, (b) your misuse of the Service, (c) your violation of these Terms, or (d) your infringement of any third-party right.
19. Force majeure
Neither party will be liable for failure or delay in performance caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, government action, labour disputes, internet or telecommunications outages, cyberattacks, or failures of upstream model providers.
20. Governing law & disputes
These Terms and any dispute arising out of or in connection with them are governed by the laws of Slovakia, without prejudice to the mandatory consumer-protection rights of your country of residence. Disputes will be submitted to the competent courts of Slovakia, except where mandatory consumer law gives you the right to sue, or be sued, in the courts of your residence.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and do not commit, to participate in alternative dispute resolution before a consumer arbitration board.
21. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- No waiver. Failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets, on at least 30 days' notice.
- Notices. Legal notices must be sent in writing to justtalkenglish@gmail.com. We may give you notice by email, in-product banner, or a post on this page.
- Language. These Terms are concluded in English. Translations are for convenience only; the English version prevails.
